What is Design?
Designs (also called as 'Industrial Designs') is the protection obtained for the outer appearance i.e the features of a shape, configuration, pattern, ornament or composition of lines or colours applied to any article. This appearance may be in 2D or 3D or in both forms, by any industrial process or means. The article should be a finished article and are judged solely by the eye. Article must have its existence independent of the Designs applied to it. The duration of protection for a registered design is ten years in India, which can be extended up to five more years after filing an application.In India , the Designs Act,2000 and the Design Rules 2001 governs the design system.
Who can file an application?
Any person claiming to be the proprietor of any new or original design may apply for registration. A proprietor may be from India or from a Convention Country. A proprietor may be:
a. an author of design,
b. a person who has acquired the design,
c. a person for whom the design has been developed by the author, or
d. a person on whom the design has devolved.
